Neuroscience is advancing at a rapid pace, with new technologies and approaches that are creating ethical challenges not easily addressed by current ethical frameworks and guidelines. One fascinating technology is neuroimaging, especially functional Magnetic Resonance Imaging (fMRI). Although still in its infancy, fMRI is breaking new ground in neuroscience, potentially offering increased understanding of brain function. Different populations and faith traditions will likely have different reactions to these new technologies and the ethical challenges they bring with them. Muslims are approximately (...) one-fifth of world population and they have a specific and highly regulated ethical and moral code, which helps them deal with scientific advances and decision making processes in an Islamically ethical manner. From this ethical perspective, in light of the relevant tenets of Islam, neuroimaging poses various challenges. The privacy of spirituality and the thought process, the requirement to put community interest before individual interest, and emphasis on conscious confession in legal situations are Islamic concepts that can pose a challenge for the use of something intrusive such as an fMRI. Muslim moral concepts such as There shall be no harm inflicted or reciprocated in Islam and Necessities overrule prohibitions are some of the criteria that might appropriately be used to guide advancing neuroscience. Neuroscientists should be particularly prudent and well prepared in implementing neuroscience advances that are breaking new scientific and ethical ground. Neuroscientists should also be prepared to assist in setting the ethical frameworks in place in advance of what might be perceived as runaway applications of technology. (shrink)

Research on human subjects is ethically justified when its anticipated results would ultimately benefit the society or public and not only the individuals participating in this research. Besides contributing to scientific knowledge, social benefits of scientific research may extend to all aspects of the public’s life including health, education, and security. In this paper, we aimed to discuss the social benefits principle as an ethical requirement for the conduct of scientific research in general and nursing research in particular. We critically (...) examined the current situation of nursing research in developing countries including its adherence to the social benefits principle and provided exemplars of both hindered and successful utilization of nursing research evidence in developing countries. We concluded that the utilization of nursing research evidence in clinical practice, education, and policy making is almost nonexistent and faces many challenges in most developing countries. Thus, most nursing research in developing countries are not currently meeting the social benefit principle of the ethical conduct of scientific research. We provided recommendations to promote the utilization of nursing research in evidence-based practice, nursing education, and health policy. (shrink)

In light of the development of “CRISPR” technology, new promising advances in therapeutic and preventive approaches have become a reality. However, with it came many ethical challenges. The most recent worldwide condemnation of the first use of CRISPR to genetically modify a human embryo is the latest example of ethically questionable use of this new and emerging field. Monotheistic religions are very conservative about such changes to the human genome and can be considered an interference with God’s creation. Moreover, these (...) changes could cause perpetual changes to future generations. The Muslim scholars establish their decisions by addressing five foundations of Islamic law i.e. “maqāṣid al sharı̄`a”; the purposes of the law. These are dın̄, nafs, nasl, `aql and māl. To achieve this, the five principles should all be met before approval of an experiment like the Chinese embryo modifications; Qaṣd which is achieved in this case as it aims to protect the embryo from HIV. Yaqın̄ and Ḍarar were not satisfied as they require strong scientific certainty of the procedures, and evidence of safety. Ḍarūra by which the alternatives being compared; in this case more established and proven safe alternatives to protect the HIV transmission from the father are available, so this principle is not met. The final principle is `Urf, by which the social context of using any contemporary technology should be taken in consideration, and clearly this was not achieved. Collectively, germline changes are rejected from an Islamic perspective until the five principles are fulfilled. In the Chinese Twins gene editing case, there was clearly no justification or support for it according to the Muslim Jurisprudence laws. These laws and approaches can serve as an ethical checklist for such controversial research, especially in early stages of the research. (shrink)

This study aimed to evaluate Jordanian pharmacy postgraduate students’ knowledge, behavior and perception about plagiarism and why do they commit such research misconduct.This is a cross-sectional survey that was conducted in Jordan during the period between June-July 2019. The study targeted postgraduate pharmacy students from all Jordanian universities. Recruited students were asked to fill out the study questionnaire to evaluate their knowledge, behavior, and perception about plagiarism.A total of 103 postgraduate students participated in this survey, most of them were enrolled (...) in masters programs. Most of them reported that they have committed plagiarism during their studies, but this work was unintended for about 76.4% of the plagiarist.Students were asked about 12 items that represented plagiarism actions and most of postgraduate students were able to identify most of the actions as plagiarism. Overall, the mean knowledge score for students about plagiarism was 8.6 ± 2.6.Regarding students’ perceptions towards plagiarism, many students believed that plagiarizing is as bad as to steal from someone and 92.2% reported that plagiarism is considered against their ethical values.This study found a high rate of plagiarism among postgraduate pharmacy students in Jordan despite their awareness and understanding of the concept and its different forms. Academic institutions must establish formal policies to raise awareness about plagiarism, enforce and implement penalties for those who commit plagiarism. (shrink)

In recent years there has been an increase in research conducted in the Middle East, with a corresponding increase in the challenges faced by members of the Research Ethics Committees. This study compares the structures of Omani and Jordanian RECs and investigates the perceptions of the challenges affecting the work of the REC members in Oman and Jordan. A convenience sample of 34 Omani and 66 Jordanian participants from 21 universities was recruited in this cross-sectional study. Almost 70% disagreed that (...) the members of RECs are unqualified, providing comments without justification; half believed that members have limited experience in research, and almost three-quarters that they have different opinions regarding some ethical issues. No significant differences were found between Omani and Jordanian REC members regarding their perception of the challenges, except for the perception that reviewing proposals is a time-consuming task and that multi-REC centres are less available. The regression model showed that there were significantly more male members of Jordanian RECs, and that Jordanian members were less likely to receive formal training. In conclusion, the current structure of RECs and the challenges faced by members need to be re-evaluated by decision makers to improve the overall quality of research activities, and to ensure that current REC members’ practices adhere to international standards. Background Fecal microbiota transplant (FMT) is a treatment modality that involves the introduction of stool from a healthy pre-screened donor into the gastrointestinal tract of a patient. It exerts its therapeutic effects by remodeling the gut microbiota and treating microbial dysbiosis-imbalance. FMT is not regulated in Jordan, and regulatory effort for FMT therapy in Jordan, an Islamic conservative country, might be faced with unique cultural, social, religious, and ethical challenges. We aimed to assess knowledge, attitudes, and perceptions of ethical and (...) social issues of FMT use among Jordanian healthcare professionals. Methods An observational, cross-sectional study design was used to assess knowledge, attitudes, and perceptions of ethical and social issues of FMT among 300 Jordanian healthcare professionals. Results A large proportion (39 %) thought that the safety and efficacy of this technique are limited and 29.3 % thought there is no evidence to support its use. Almost all (95 %) responded that they would only perform it in certain cases, if ethically justified, and 48.3 % would use it due to treatment failure of other approaches. When reporting about reasons for not using it, 40 % reported that they would not perform it due to concerns about medical litigation, fear of infections (38 %), and lack of knowledge of long safety and efficacy (31.3 %). Interestingly, all practitioners said they would perform this procedure through the lower rather than upper gastrointestinal tract modality and the majority will protect the patient’s confidentiality via double-blinding (43.3 %). For a subset of participants (n = 100), the cultural constraints that might affect the choice of performing FMT were mainly due to donor’s religion, followed by dietary intake, and alcohol consumption. Conclusions Our healthcare practitioners are generally reluctant to use the FMT modality due to religious and ethical reasons but would consider it if there was a failure of other treatment and after taking into consideration many legislative, social, ethical and practice-based challenges including safety, efficacy and absence of guidelines. The study sets out to develop an online course for medical professionals who are not native Arabic speakers. The present study relied on a questionnaire developed by reviewing relevant theoretical literature and prior research in order to apply descriptive and analytical methods to accomplish the study's aims. The researcher sent an online questionnaire to a large number of healthcare workers, including doctors, nurses, lab techs, and radiology technicians. The objective of this survey is to learn about the linguistic communication needs (...) of healthcare workers and to find out when Arabic is useful for communicating with patients and meeting quality standards in healthcare. The study compiled a list of 36 linguistic needs pertaining to various medical settings (e.g., emergency rooms, outpatient clinics, hypnosis rooms, labs, and radiology departments), developed an electronic program to teach Arabic to non-native speakers, and made several suggestions and recommendations. El estudio de dos formularios notariales del siglo vii/xiii, uno sirio y el otro andalusí, muestra que el discurso sobre las modalidades de comunicación escrita preceptuadas para los jueces refleja una estrecha relación entre la doctrina y la realidad de la práctica legal. Uno de los aspectos de esta relación es el cambio que tuvo que experimentar la doctrina discursiva bajo la presión de las prácticas judiciales cotidianas.

En el presente artículo se propone crear un margen conceptual para la construcción de una criminología fenomenológica que aborde el conocimiento de cómo se interpretan las conductas de las personas a través de las percepciones de otros, enfocado a la constitución de la conducta criminal, delincuencial, violenta o antisocial, que, siendo estos provenientes de la naturaleza de variadas ciencias, provoca tener horizontes amplios en el entendimiento que en la misma esencia lo vuelven complejo, la criminología actual, tiene en sí, varios (...) objetos de estudio que ha tomado de aquellas ciencias que tienen en su qué hacer lo relacionado con el crimen, de tal modo, desde el derecho, se estudia el delito y sus elementos, desde la psiquiatría y psicología, la conducta antisocial y su desarrollo, de la sociología, la conducta desviada patológica y su formación, el trabajo social, aporta otras interpretaciones, lo mismo, cuando corresponde a la antropología de la violencia, su historia, percepciones, cambios culturales, entre muchas otras. En ello radica la complejidad en la armonización de objetos de estudio que encuentran reunión en la criminología en una integración interdisciplinaria, pero esta se agota ante la abrumante realidad criminal que afecta a la aldea global, donde poco tiempo permite a la reflexión, necesitando con urgencia la intervención. El caso abordado aquí, es dar esa aproximación a una criminología fenomenológica, que pasará previo a su desarrollo, por el proceso de especialización de la criminología, soltando por momentos el paradigma clásico, para avanzar al futuro en la sistematización de teorías de otras ciencias, para generar un banco de conocimientos, que permitirán a posteriori, desarrollar sus propias concepciones e interpretaciones. Pp. lviii + 204. $55.00.Wael Hallaq's most readable translation of Ibn Taimiyya's famous work is complemented by a masterful introduction and intelligent, relevant footnotes. In addition, he has taken care to help the reader in many ways, adding, for example, a (...) list of the emendations he has made to the Arabic text as well as a table that details the correspondence between the paragraphs of his translation and the pages and lines within the more standard Arabic texts.The editor-translator's introduction sets forth Ibn Taimiyya's teaching in a clear and well-argued manner, something that is necessary given the repetitiveness and confusing arguments that characterize the original. Though Hallaq tends to reveal himself to be something of a partisan of Ibn Taimiyya's doctrines and thus to overstate the case for his author, this is a minor flaw. The strength of the Introduction is such that the student of logic or philosophy is compelled to indicate the problems in Hallaq's presentation, that is, to identify the reasons for not being persuaded by his exposition. [End Page 273] To do so, however, is merely a means of carrying the argument a step further and thus a compliment of sorts to Hallaq.As I see it, there are five areas where one might take issue with the editor-translator's presentation of Ibn Taimiyya's teaching. First, because he follows his author too closely, Hallaq relies too much on Avicenna and on Avicenna's commentators to present the position of the philosophers. He seems to ignore that the teaching of Avicenna—he whom Averroes would identify only as "that man"-—is problematic even for the philosophers. Second, Hallaq relies too much on secondary literature in order to present the history of philosophy. He would have been far better advised to trace the history of philosophy for himself, especially the history of medieval Islamic philosophy. By relying on others, especially those whose interpretations are open to major objections, he weakens his own presentation. This tendency becomes especially evident in what I take as a third point of criticism, namely, Hallaq's too ready conflation of the history of philosophy and consequent willingness to blame ancient and medieval philosophers for the folly of modern philosophers (see xxx, n. 98 and xviii:17-18). Worse, Hallaq eventually becomes so carried away with the desire to refute the ancient and medieval philosophers that he no longer cares about the evil consequences of modern philosophy (see xviii:8-xlix:20, esp. xlviii:8-29). Indeed, and this is the fourth criticism, so intent is Hallaq on confirming that Ibn Taimiyya has refuted the philosophers that he is content to call anyone a philosopher, even al-Suhrawardī, al-Baghdādī, al-Tūsī, and, wonder of wonders, Fakhr al-Dīn al-Rāzī (see xliv:4). Though he has good guidance for this from Ibn Taimiyya, one would hope for more objectivity from the critical scholar than from the engaged defender of the faith. Finally, Hallaq actually introduces Ibn Taimiyya's wider teaching rather than the argument of this book, thereby neglecting the primary function of an introduction to a book. Thus, of 91 notes in the Introduction that refer to Ibn Taimiyya's works, only slightly more than half (52) cite this work. The other 39 are to Ibn Taimiyya's other writings. Moreover, many of the 52 notes to this work also refer to other writings by Ibn Taimiyya.Thankful as we must be to Hallaq for this translation, it is most unfortunate that he chose not to be consistent in his translation of Arabic terms. Apparently, he thought he could make more sense of Ibn Taimiyya's argument by translating terms in accordance with what he took to be the sense of what Ibn Taimiyya wished to say rather than in accordance with what he actually says. The history of Iraq in the twentieth century, and perhaps the Middle East more broadly, is punctuated by an intellectual shift that has, for the most part, escaped the attention of scholars. It might be characterized as a shift from a problem of representation introduced by the rise of left-wing politics, to a problem of experience created by its failure. This shift registers in the work of writers and artists, where the depiction of the social world gave way to an (...) exploration of states of being. The paradigm for that turn inward in modern art was set by the artist Kadhim Haidar, in a series of paintings exhibited at the National Museum of Modern Art in Baghdad, in 1965, under the title The Epic of the Martyr [Malḥamat al-shahīd]. The paintings reconstructed imagery from the mourning processions that annually commemorate the martyrdom of the Prophet Muhammad’s grandson, al-Husayn. This paper argues that the ritual imagery contains a grammar of experience, forged in the early history of Islam, that linked justice to a state of being, and that the transposition of the imagery into painting activated that grammar in the artwork. The article discusses sexual violence by ISIS against women in Iraq, particularly Yezidi women, against the historical background of broader sexual and gender-based violence. It intervenes in feminist debates about how to approach and analyse sexual and wider gender-based violence in Iraq specifically and the Middle East more generally. Recognizing the significance of positionality, the article argues against dichotomous positions and for the need to look at both macrostructural configurations of power pertaining to imperialism, neoliberalism and globalization on the one (...) hand, and localized expressions of patriarchy, religious interpretations and practices and cultural norms on the other hand. This chapter examines whether, why and how fundamental powers of human reflexivity deserve fuller consideration by liberal egalitarian theories of justice. The discussion focuses on two reflexive powers. Firstly, social reflexivity which can broadly be defined as each person’s capacity to formulate, respond and act on the question: ‘how should I make my way through the social world?’ Secondly, political reflexivity which can broadly be defined as each person’s capacity to formulate, respond and act on the question: ‘how can we (...) steer society together?’ I discuss why each of these reflexive powers matters all the more in the context of a morphogenic society; to what extent they seem to be missing from key theories of justice; what other personal powers are required for the realisation of these forms of reflexivity; and what sort of organisations might be conducive to fostering these powers.
